Divorce
You can only be divorced in the Netherlands if you meet the legal requirements for the divorce to be processed. You must either both be Dutch, or have been legally residing in the Netherlands for 12 months, or one of you must be Dutch and have been living in the country for at least six months. There is also the possibility that you can petition the district court in Den Haag if one of you is Dutch but neither of you live in the country. One or both partners can file a petition for divorce at your local district court. If only one of you is filing divorce and the other does not agree, the person filing will have to prove irrevocable differences in a court of law. Under Dutch law there are four consequences of divorce that will need to be sorted out: for this you will need a mediator who will also help you to come to terms with the divorce during the process. The four consequences are: children (child support and custody), partner alimony, and division of marital property and pension rights.
